24 October 2018 | Updated 12 June 2019
Overview/background
On 24 October 2018 the ACCC published guidelines on the procedures and approach it will take when exercising legal powers under s 155 to obtain information, documents and evidence.
The Guidelines were updated in June 2019 to incorporate changes made by the Competition and Consumer Amendment (Competition Policy Review) Act 2017 - specifically, the ACCC site indicates changes were made in relation to:
- the reasonable search defence
- the written response
- the ACCC's preference for a declaration of search processes
- guidance on electronic document production.
