In force since August 2008, the new Chinese merger control regime is relatively young. Not surprisingly, many issues are still in flux. Although the business community is still eagerly waiting for new implementing measures - in the form of regulations or guidelines - to be adopted on the merger control thresholds and procedure, a sort of manageable status quo has settled in. This article attempts to provide some information on practical issues and recommendations for parties filing merger notifications to the Ministry of Commerce (MOFCOM) in the current - likely transitional - period of enforcement of China’s Anti-Monopoly Law (AML). .
