Part IIIA of the Trade Practices Act: Reflections after Fortescue

Abstract
'A recent decision of the Australian Competition Tribunal has identified a number of issues arising in respect of the third party access regime in Part IIIA of the Trade Practices Act 1974 (Cth).This article considers these issues and makes a number of recommendations in relation to the reform of Part IIIA.'
