Abstract

From time to time it is important to review legislation to ensure that it continues to achieve its objective efficiently and effectively. The Harper Review of the Competition and Consumer Act 2010 (Cth) provides the opportunity not only to review the effectiveness of the Act but to consider simplification of what has become a highly prescriptive and complex piece of legislation. This article considers one possible simplification, conflation of the various sections which relate to anticompetitive agreements and the consequences of this.
