This report provides an overview of the functions performed by the National Competition Council (NCC), the designated Minister, and the Tribunal under the national access regime, identifies how the understanding of the Tribunal's role in reviewing access declaration decisions has narrowed significantly in recent years, and explores the reasons why the Panel has recommended a return to a broader concept of the Tribunal's review function.'
