The long-awaited decision of the High Court of Australia in Australian Competition and Consumer Commission v Flight Centre Travel Group Ltd on 14 December 2016 extends the range of cases where principals and agents are likely to be characterised as being in competition with each other for the purpose of cartel-related prohibitions. The decision reverses the decision of the Full Court of 14 August 2015.
